1. General
1.1. These Conditions of Sale (Conditions) apply to all tickets sold by Marriner Group (Vic) Pty Ltd (“we”, “us”, “our”) for events at our venues through our authorised ticketing channels. By purchasing or using a ticket, you agree to these Conditions, together with our Conditions of Entry and any event-specific terms notified at the time of purchase. These Conditions apply to both the original purchaser and any subsequent ticket holder.
1.2. Some events are presented, produced or promoted by a third party. In these Conditions, the presenter, producer, promoter or organisation responsible for the event is referred to as the “Event Organiser”.
1.3. We reserve the right to change these Conditions at any time effective immediately upon posting on our website. Any changes to these Conditions will only apply to purchases made after these conditions have been updated.
1.4. We operate in accordance with the Live Performance Australia Ticketing Code of Practice (Code). A copy of the Code is available for review at marrinergroup.com.au/policies.
2. Ticket Purchases, Prices and Promotions
2.1. Before completing your purchase, you are responsible for checking and confirming that the event, date, time, venue, ticket type, any applicable restrictions and any published event details are suitable for you and anyone attending with you.
2.2. All prices are stated in Australian dollars and are inclusive of fees and charges as notified at the time of purchase and as required by law. Optional charges may be displayed separately.
2.3. Ticket prices may be changed at any time, including through promotional offers, discounts or other pricing adjustments. The price payable for a ticket will be the price displayed at the time the transaction is completed. No refunds, credits or exchanges will be offered as a result of any subsequent change in ticket price or promotional offer.
2.4. Promotional offers may be subject to limited availability, specific terms and conditions including those of third parties, and may be withdrawn at any time without notice. We may correct a pricing, availability, event or seating information error or cancel a transaction affected by such an error, subject to applicable law.
2.5. Some tickets for events may be subject to restricted viewing limitations which will be made known to you prior to purchasing the ticket.
2.6. Any membership, loyalty, rewards, or optional ticket protection products offered may be subject to separate terms and conditions.
2.7. Your ticket may also be subject to additional terms and conditions determined by the Event Organiser. Where applicable, those terms may be published with the event information on our website, provided during the ticket purchase process, or made available on request.
3. Refunds, Exchanges and Event Changes
3.1. Subject to clause 3.2 and any rights you have under applicable law, tickets will not be refunded or exchanged because of a change in your personal circumstances or external circumstances beyond our reasonable control (for example, adverse weather).
3.2. Subject to clause 3.4, if an event is cancelled, you will be entitled to a refund in accordance with the Code and applicable law. If an event is rescheduled or significantly relocated and you are unable or unwilling to attend the rescheduled or relocated event, you may request a refund in accordance with the Code and applicable law, within any reasonable timeframe notified to you. We may offer an exchange (where available) or other remedy as an alternative, but you are not required to accept an exchange where you are entitled to a refund. Nothing in these Conditions limits any other remedy available to you under Australian Consumer Law or applicable law.
3.3. Where an event is cancelled and you are entitled to a refund, we will attempt to process that refund to the payment method used for the original purchase without requiring you to submit a request, unless you have accepted an exchange. If the original payment method is no longer available, we will contact you to arrange an alternative method of payment.
3.4. If an event is affected by a natural disaster, public health emergency, government directive, or another circumstance beyond our reasonable control, refunds or other remedies will be handled in accordance with the Code, applicable law, and the ticket terms applying at the time of purchase.
3.5. We or the Event Organiser may, where reasonably necessary, cancel or reschedule an event; amend the advertised program, including by adding, withdrawing or substituting artists or performers; or change event dates, performance times, seating arrangements or audience capacity.
3.6. Where a main performer in a music concert or single-person performance is permanently replaced, we will notify you and handle any refund request in accordance with the Code and applicable law. The use of understudies or temporary substitute performers does not entitle you to a refund, although we will notify patrons where reasonably practicable.
3.7. To the extent permitted by law, variations to an event (other than a permanent replacement of a main performer in a music concert or single-person performance) do not entitle you to a refund except as outlined above.
4. Admission and Conditions of Entry
4.1. All patrons, including children and infants, must hold a valid ticket unless otherwise specified. Children and infants under the age of 12 must be accompanied at all times by a parent or guardian.
4.2. The right of admission is reserved. Entry may be refused or revoked where reasonably necessary, including where you breach these Conditions or the Conditions of Entry.
4.3. Events may be subject to age restrictions. It is your responsibility to ensure prior to purchase that you can attend the event if age restrictions are in place. At the point of entry of any event, you may be required to present your ticket and a matching form of legal photo identification (e.g., driver's licence, passport, or State Approved 'Proof of Age' card) to obtain admission.
4.4. If you arrive late to an event, you may not be admitted until a suitable break in the event and may be seated at an alternative location to minimise disruption. We may relocate seats where reasonably required for operational, safety or production reasons.
4.5. Admission to the venue is subject to our Conditions of Entry, including restrictions on recording devices, cameras and mobile phone usage, requirements relating to behaviour, intoxication, safety and compliance with venue policies, compliance with any government directions or public health requirements, and security screening of your person and/or possessions as a condition of entry. The Conditions of Entry are also displayed at the venue.
4.6. By attending an event, you acknowledge that you may be photographed, filmed or recorded. We may use such recordings without compensation for archival, security, promotional and publicity purposes, provided such use is not inconsistent with applicable law.
5. Ticket Validity, Limits and Resale
5.1. Only tickets obtained through our authorised sales channels will be recognised for entry. We reserve the right to refuse admission where we reasonably believe a ticket is not authentic or valid, including because it has been damaged, defaced, duplicated or altered.
5.2. Each ticket admits one person only. Where duplicate copies exist, we reserve the right to deny entry to holders of all duplicate tickets including the original ticket holder.
5.3. We may impose limits on the number of tickets that you can purchase for an event. Tickets purchased in excess of any stated ticket limit may be cancelled and refunded. No refund will be given in instances where the purchase involved fraud, misuse or breach of these Conditions.
5.4. We may refuse entry or cancel a ticket order if we reasonably suspect fraud or unauthorised activity. This includes where we reasonably believe an unauthorised payment method has been used, purchasing activity appears unusual or suspicious, multiple purchases appear intended to circumvent ticket limits or our ticketing processes, information provided in connection with the purchase appears incomplete, inaccurate or inconsistent, automated software, bots or similar technology appear to have been used to make the purchase, or due to breaches of our Website Terms of Use policy. This clause also applies where there are other reasonable grounds to suspect fraud or unauthorised activity.
5.5. Tickets must not be resold for more than their original purchase price or used for advertising, promotional or other commercial purposes without our prior written approval. Subject to applicable law, if a ticket is used in breach of this clause, we may cancel the ticket without refund and refuse admission to the ticket holder. Ticket resale may also be regulated by applicable ticket sales legislation.
5.6. You are responsible for ensuring your tickets are kept secure. Lost, stolen or damaged tickets may not be replaced except at our discretion or as required under the Code.
5.7. We may delay issuing your tickets until closer to the event time to protect the integrity of the tickets and/or due to government direction.
5.8. If you purchase a concession ticket, you must produce valid proof of your eligibility when attending the event. This includes any Companion Card bookings.
6. Content Suitability and Customer Discretion
6.1. Events may contain themes, language or other content, or may otherwise be considered inappropriate for certain audiences. Before purchasing tickets, you should consider whether the event is appropriate for you and anyone attending with you.
7. Use and Liability
7.1. Use of our website and ticketing platform may also be subject to our Website Terms of Use and Privacy Policy available at marrinergroup.com.au/policies.
7.2. To the extent permitted by law, our liability to you under these Conditions is limited to the total amount paid by you for the ticket, including any booking and transaction fees, and we are not liable for any indirect or consequential loss, including travel or accommodation costs. Nothing in these Conditions excludes, restricts or modifies any rights you may have under the Australian Consumer Law or applicable state-based legislation.
8. Contact and Complaints
8.1. We are committed to resolving complaints fairly and promptly. If you have a complaint, please contact us in the first instance using the contact details below or on our website. We will acknowledge your complaint as soon as practicable and endeavour to resolve it within a reasonable timeframe. If your complaint is not resolved to your satisfaction, you may refer it to the LPA Complaints Officer at complaints@liveperformance.com.au.
